New Provisions for Continuation fo Dependent Child Coverage

On July 1st 2008 HF 2539 went into effect. This legislation passed by the Iowa Legislature includes both changes to dependent eligibility and creditable coverage for non-government program insurance subscribers in Iowa. Each Health Insurance Carrier has interpreted the law as they see fit their contracts.

The new law changes the maximum age for children to remain covered until the age of 25, which was formerly 19 years old in most cases. There is no maximum age for full-time students under this law.

The types of plans that are affected by the state regulation are: Individual plans, insurance plans provided by employer groups subject to Iowa law and self-funded plans for employees of state, county or municipal governments are subject to this law. Many large employers and medium-sized employer group will not be subject to this law, if they are self-funded plans, as such plans are not subject to regulation by this state.
